These Terms of Service govern your use of ferzalon.com and your purchase of products from us. Ferzalon is a trading name of ULIKE E-COMMERCE CO., LIMITED, Unit 903, 9/F, Cameron Commercial Centre, 458–468 Hennessy Road, Causeway Bay, Hong Kong SAR ("Ferzalon", "we", "us"). By placing an order you agree to these terms, so please read them before you buy.

Who may buy

You must be at least 18, or the age of majority where you live, and able to enter into a binding contract. By ordering you confirm that the payment method is yours and that the details you have given us are accurate and complete.

Your account

You may check out as a guest or create an account. If you create one, keep your password confidential and tell us promptly if you think someone else has used it. You are responsible for activity through your account. We may suspend or close an account used for fraud, abuse, or any unlawful purpose.

Products, descriptions and photography

We describe every piece as accurately as we can. Everything we sell is hand-painted earthenware, made in small batches, and it varies: the motif sits slightly differently on each piece, the rim strokes differ in width, the number of dashes round an edge is not fixed, and on the langoustine plate even the number of langoustines varies. Small pinholes or specks in a glaze are normal in earthenware. That variation is a property of the way these are made and is not a fault.

Dimensions and capacities are approximate. Screens render colour differently, so the shade you see may not match the piece that arrives exactly.

Prices and payment

All prices are in United States dollars and include applicable taxes where stated at checkout. Shipping is calculated and shown before you confirm. We may change prices at any time, but a change never affects an order we have already accepted.

Payment is taken when you place your order. If your payment is declined or reversed we may cancel the order. We do not store full card details; payments are handled by our payment providers.

Orders and acceptance

Your order is an offer to buy. Our confirmation email acknowledges that we received it, and the contract is formed when we dispatch the goods. We may decline or cancel an order if a piece is out of stock, if a price or description was clearly wrong, if we cannot ship to your address, or if we suspect fraud. If we cancel after you have paid, we refund you in full.

Pricing and content errors

A listing may occasionally carry an incorrect price or description. Where the error is obvious and a reasonable person would recognise it as a mistake, we are not obliged to supply at the wrong price. We will contact you, and you may confirm at the correct price or cancel for a full refund.

Delivery

Delivery times, carriers and costs are set out in our Shipping policy, which forms part of these terms. Risk in the goods passes to you on delivery to the address you gave us.

Returns and refunds

Your return rights are set out in our Return and refund policy, which forms part of these terms. Nothing in these terms limits any statutory rights you have as a consumer.

Suitability and safe use

Our pieces are tableware for domestic use. All of them are dishwasher and microwave safe. None of them is ovenproof, and none should be used on a hob, under a grill or in a freezer. Earthenware is damaged by sudden changes of temperature, so do not take a piece from the fridge under hot water or set a pan straight off a flame onto it. We are not liable for damage caused by use outside these limits.

Intellectual property

The Ferzalon name, our painted designs, product photography, written copy and the design of this site belong to us or our licensors. You may not copy, reproduce, adapt or use them commercially without our written permission. Buying a piece does not transfer any rights in the artwork painted on it.

Acceptable use

You agree not to use this site to break the law, to interfere with its operation or security, to scrape or harvest data, to place fraudulent or speculative orders, or to upload anything harmful or unlawful. We may restrict access where we reasonably believe this has happened.

Reviews and content you submit

If you submit a review, photograph or other content, you confirm it is yours to share and grant us a non-exclusive, royalty-free licence to display and use it in connection with our business. We may remove content that is unlawful, misleading, abusive or off-topic.

Links to other sites

Where we link to a third-party site we do so for convenience. We do not control those sites and are not responsible for their content, products or privacy practices.

Availability of the site

We aim to keep ferzalon.com available but do not guarantee uninterrupted access. We may suspend, withdraw or change any part of it for maintenance or business reasons without notice.

Our liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.

Subject to that, we are not liable for indirect or consequential loss, loss of profit, loss of business or loss of data, and our total liability in connection with any order is limited to the amount you paid for that order. We supply for domestic and household use and are not liable for loss arising from commercial use.

Events outside our control

We are not responsible for delay or failure caused by events beyond our reasonable control, including carrier disruption, customs delays, extreme weather, industrial action, power or network failure, or government action. Where such an event affects your order we will contact you, and if the delay is substantial you may cancel for a full refund.

Changes to these terms

We may update these terms from time to time. The version in force when you place your order is the version that applies to it. The date at the top shows when this page was last revised.

Governing law

These terms and any dispute arising from them are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong SAR have non-exclusive jurisdiction. If you are a consumer resident elsewhere, you keep the benefit of any mandatory protections of your local law.

General

If any provision is found unenforceable, the rest continues in force. Our failure to enforce a term is not a waiver of it. These terms, together with our Return and refund policy, Shipping policy and Privacy policy, form the whole agreement between us.
